For your State answer the following:

  • Common Law. Explain the two extreme views as to who is an "employee". Explain four other factors that could be relevant to the decision as to who is an employee.
  • Long Service Leave. Who must receive LSL? Is the recordkeeping onerous for employers? Explain.
  • Occupational Health and Safety. Who has general and specific duties relating to OH&S? With regard to ‘particular additional duties’, explain to what extent they could affect a HB operator who has paid employees.
